
Terms and Conditions

These Terms and Conditions govern the booking and provision of tourism services offered by Murillos Bros Adventours, S.C. de R.L. de C.V., located at 107 Puerto Vallarta Street, between Puerto Tampico and Puerto Escondido Streets, Centro neighborhood, ZIP Code 23740, Puerto San Carlos, Municipality of Comondú, Baja California Sur, Mexico.
By requesting a reservation, making a payment, or participating in any activity, the customer acknowledges that they have read and accepted these Terms and Conditions.
1. Reservations
Reservations may be requested through our website, WhatsApp, email, social media, or authorized booking platforms.
All reservations are subject to:

Availability of dates, vessels, captains, and guides.

Meeting the minimum number of participants.
-
Receipt of the required deposit.
-
Express confirmation from Murillos Bros Adventours.
Submitting a request does not guarantee a reservation until the customer receives confirmation.
2. Deposit and payment
A deposit equal to 30% of the total amount is required to confirm a reservation.
The remaining balance must be paid before the activity begins, unless a different payment date has been agreed upon in writing.
Payments may be made using the methods provided during the booking process. The customer must submit proof of payment so that the payment can be identified and confirmed.
Prices are stated in Mexican pesos. When applicable, 16% VAT will be added and clearly disclosed before the reservation is confirmed.
3. Prices
The applicable price will be the amount stated in the quotation and reservation confirmation.
Promotions, discounts, and special rates:

Are subject to availability.

Cannot be combined unless expressly stated otherwise.

May have specific dates or conditions.

Cannot be applied retroactively to confirmed reservations.
Prices may change; however, no change will affect a reservation that has already been confirmed and paid.
4. Minimum number of participants
Some group departures require a minimum of four participants.
If the required minimum is not reached, Murillos Bros Adventours may:

Offer an alternative date.
-
Offer a private departure at an adjusted price.

Keep the payment as credit for a future activity, with the customer’s authorization.

Refund the amounts paid.
No additional charge will be made without the customer’s prior authorization.
5. Vessel capacity
Each vessel has a maximum capacity of six passengers, in addition to the authorized crew.
Vessels will be assigned according to the number of participants, route conditions, authorized capacity, and operational availability.
For safety reasons, the authorized capacity may not be exceeded.
6. Customer cancellations
Cancellations requested by the customer are subject to our Cancellation Policy, published on our website and accepted when the reservation is confirmed.

The date and time the request is received will be used to calculate any applicable refund.
Nonrefundable bank or payment-platform fees may be deducted from the refund, provided that the customer is informed.
7. Cancellations by Murillos Bros Adventours
Murillos Bros Adventours may cancel, suspend, or modify an activity due to:

Unfavorable weather or sea conditions.
-
Port closure.
-
Restrictions imposed by the authorities.
-
Mechanical failures that compromise safety.
-
Emergencies, accidents, or force majeure.
-
Circumstances that place participants or crew members at risk.
In these cases, the customer may choose to reschedule the activity, receive credit for a future service, or request a refund of the amount paid for the service that was not provided.
Murillos Bros Adventours will not be responsible for external expenses such as accommodations, ground transportation, flights, meals, or services booked separately.
8. Punctuality and failure to appear
The customer must arrive at the meeting point at the time stated in the reservation confirmation.
We recommend arriving at least 15 minutes early. Late arrival may reduce the duration of the activity and, when it prevents the departure from taking place, may be considered a failure to appear.
Failure to appear without prior notice will not entitle the customer to a refund unless otherwise required by applicable law.
9. Changes requested by the customer
Changes to the date, activity, number of participants, or type of service are subject to:

Availability.

Season.
-
Rate differences.
-
Vessel capacity.
-
The applicable Cancellation Policy.
A change will only be valid after it has been confirmed in writing by Murillos Bros Adventours.
10. Activity conditions
Schedules, durations, routes, and itineraries are approximate and may be modified due to safety concerns, weather, tides, sea conditions, wildlife presence, instructions from the authorities, or operational requirements.
The captain or guide in charge may:

Modify the route.

Change the landing location.
-
Suspend water activities.
-
Order an early return.
-
Prevent any activity that poses a risk.
These decisions will prioritize participant safety and environmental protection.
11. Wildlife observation
Activities take place in natural environments with free-ranging wildlife. Therefore, the sighting, proximity, number, or behavior of any species cannot be guaranteed.
The absence of wildlife will not be considered a failure to provide the service and will not automatically entitle the customer to a refund, provided that the booked tour was carried out.
12. Participant safety and responsibilities
Participants must:

Follow the instructions of the captain, guide, and staff.

Use safety equipment correctly.
-
Report any relevant medical condition, allergy, injury, pregnancy, or physical limitation.

Refrain from actions that could place the group at risk.
-
Respect the vessel, equipment, wildlife, and natural environment.
-
Comply with the rules of protected natural areas and maritime authorities.
-
Not participate while under the influence of alcohol or substances that impair their abilities.
Murillos Bros Adventours may deny participation or remove from an activity anyone who poses a risk to themselves, other people, wildlife, or equipment.
13. Health condition
The customer is responsible for determining whether their physical condition and health are suitable for the booked activity.
Medical information provided by a participant will be treated confidentially and used solely for their safety and care, in accordance with our Privacy Notice.
When circumstances require it, Murillos Bros Adventours may request medical clearance or recommend that a person not participate.
14. Minors
Minors must participate while accompanied by their parent, legal guardian, or an authorized adult.
The responsible adult must provide the requested information and authorize the minor’s participation.
Some activities may have specific age restrictions for safety reasons.
15. Food and allergies
When food is included in the service, the customer must provide advance notice of any allergy, intolerance, or dietary restriction.
Reasonable accommodations will be made when possible; however, the complete absence of cross-contamination cannot be guaranteed.
16. Equipment and personal belongings
Customers are responsible for taking proper care of the equipment provided to them. Damage caused intentionally, negligently, or through use contrary to instructions may be charged to the responsible person.
Murillos Bros Adventours will not be responsible for the loss of or damage to phones, cameras, drones, money, documents, or other personal belongings, except when directly attributable to negligent conduct by Murillos Bros Adventours.
We recommend protecting electronic devices and avoiding bringing unnecessary valuables.
17. Photographs and videos
Photographs or videos may be taken during activities. Their use for advertising or promotional purposes will require the corresponding authorization.
Participants may inform us that they do not wish to appear in publications or promotional materials. For minors, authorization must be provided by their parent or legal guardian.
18. Environmental protection
All participants must comply with the rules applicable within the Pacific Islands of the Baja California Peninsula Biosphere Reserve, as well as instructions issued by CONANP, maritime authorities, and other competent authorities.
The following actions are prohibited:

Feeding, chasing, touching, or disturbing wildlife.

Removing plants, animals, shells, or other natural materials.
-
Disposing of waste or pollutants.
-
Damaging mangroves, dunes, beaches, or nesting sites.
-
Fishing or capturing wildlife without authorization.
19. Separately booked services
Services booked separately by the customer, including accommodations, transportation, flights, meals, or other arrangements, remain subject to their own booking conditions.
Murillos Bros Adventours will not be responsible for changes, cancellations, losses, or expenses associated with services that were not included in the confirmed reservation.
20. Liability
Murillos Bros Adventours will provide its services using trained personnel, authorized vessels, and reasonable safety measures.
Participants acknowledge that marine, nature-based, and adventure activities involve risks inherent to the environment. This acknowledgment does not release Murillos Bros Adventours from its legal responsibilities or limit any consumer rights that cannot legally be waived.
21. Captain and guide services
All vessel departures will be operated by a captain responsible for navigation and passenger safety.
Depending on the activity, group size, operational conditions, and staff availability, a service may be operated:

By a captain and a separate guide.

By one qualified person acting as both captain and guide.

By a captain only, on tours that do not require a separate guide.
The number of crew members may vary without being considered a reduction in the service, provided that:

The safety and quality of the activity are maintained.

The activities and information offered are provided.
-
Operational and vessel-capacity requirements are met.
-
The quotation does not expressly guarantee a captain and a guide as two separate individuals.
When a guide is required because of the difficulty of the activity, water entry, group characteristics, safety requirements, or applicable regulations, the activity will not take place without the appropriate personnel.
If the customer expressly books and pays for a separate guide, any change must be disclosed and agreed upon before the activity begins.
22. Personal information
The information provided will be processed in accordance with the Privacy Notice published on our website.

24. Applicable law
These Terms and Conditions will be interpreted in accordance with the laws of the United Mexican States.
Any dispute will first be addressed through direct communication. If an agreement cannot be reached, the parties may seek assistance from the competent authorities without limiting the customer’s applicable consumer rights.
25. Acceptance
By confirming a reservation or making a payment, the customer acknowledges that they:

Received sufficient information about the service.

Know the applicable price and conditions.

Read and accepted these Terms and Conditions.

Read the Cancellation Policy and Privacy Notice.

Provided truthful and sufficient information for the service to be provided.
